Terms and Conditions

The following terms ("Terms of Use") constitute an agreement between True North Leatherworks LLC, a Virginia limited liability company ("TNL"), and the purchaser ("You") of the Leatherwork 101 course (the "Course") found at https://www.truenorthleatherworks.school the “Website”), on behalf of the user (“User”) of the Course that governs Your and User’s purchase and use of the Course. You, on behalf of Yourself and User, agree to abide by the Terms of Use as a condition of Your purchase of the Course.  If You are purchasing the Course on Your own behalf or on behalf of a User (including a minor), you agree to carefully review these terms and represent and warrant that you have the authority to agree to them on your own behalf or on behalf of the User.

 

Your purchase of the Course constitutes Your acceptance of, and agreement to the following Terms of Use on behalf of Yourself and User. TNL reserves the right to modify, alter, amend or update its Course, policies and these Terms of Use. These Terms of Use are subject to change without notice. If You do not agree with or do not accept any part of these Terms of Use, You should not purchase the Course. 

 

Disclaimer

We have made every effort to ensure that all information in the Course has been tested for accuracy. We make no guarantees regarding the results that You or User will see from using the information provided in the Course. 

 

TNL disclaims liability for incidental or consequential damages and assumes no responsibility or liability for any loss or damage suffered by any person as a result of use of the information or products provided in the Course. TNL assumes or undertakes no liability for any loss or damage suffered as a result of the use of any information or products found in the Course.

 

The Course includes tutorials about how to use leatherworking tools and complete leather working projects. All such tutorials have been tried and completed successfully, but results may vary from person to person. 

 

Some tutorials may include the use of tools, such as craft knives, rotary cutters, and awls, which can cause injury. You acknowledge and agree that use of leatherworking tools by User may result in injury, including death or disfigurement of User or others or damage to property and that You are solely responsible for any such injuries, death or damages. You further agree to supervise any User while using the Course or other materials or tools provided in connection therewith. By voluntarily following any tutorial provided in the Course or otherwise using the tools or materials provided therewith, You, on behalf of Yourself or any User, assume the risk of any potential injury that may result. 

 

Your Responsibility

The Course was developed strictly for educational purposes. You understand and agree that You, on behalf of User, are fully responsible for User’s participation and results from the Course. TNL makes no representations, warranties or guarantees. You understand that results may vary from person to person. You understand that TNL is not responsible for Your or User’s results or any expenses that You or User may incur as a result of Your purchase. TNL assumes no responsibility for errors or omissions that may appear in the Course. 

 

Purchase Policies 

You may purchase the Course on the Website.  The Course is provided through video content and written tutorials that are available on https://www.truenorthleatherworks.school. Course content is available only to Users who have enrolled in the Course. After purchase, User will have access to the Course so long as the Company maintains the Course as a product offering.

 

Refund Policy

TNL will provide a refund for the Course provided You contact TNL at [email protected] within 21 days of the start of the course (before the fourth lesson is released) to request a refund and return all tools and materials at your expense. TNL will provide You with instructions on returning the Course. Items returned to TNL without prior approval will not be accepted. 

 

TNL will notify You once we’ve received and inspected Your return, and let You know if the refund was approved or not. If approved, You will be refunded the purchase price of the item on Your original payment method. Please remember it can take some time for Your bank or credit card company to process and post the refund too. Shipping charges are non-refundable.

 

Damages and issues

Please inspect Your order upon receipt and contact TNL immediately if the item is defective, damaged or if You receive the wrong item, so that we can evaluate the issue.

 

Intellectual Property

All original materials provided by TNL as part of the Course are owned by TNL. Any original materials are provided for User’s individual use only. You and User are not authorized to use or transfer any of TNL’s intellectual property. All intellectual property remains the property of TNL. No license to sell, distribute, reproduce, prepare a derivative work, display or perform is granted or implied. TNL will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations. 

 

Certain of the names, logos, and other materials displayed in the Course constitute TNL’s intellectual property, including, but not limited to, patents, trademarks, service marks, trade secrets and copyrights (“TNL IP"). You and User are not authorized to use any TNL IP without TNL’s express consent. Ownership of TNL IP remains with TNL and You, on behalf of Yourself and User, agree not to make any claims or assertions of any other party’s ownership of TNL IP.

 

Leatherwork 101 is a trademark of TNL and is protected by United States trademark law. TNL’s trademarks and trade dress may not be used in connection with any product or service that is not TNL's, in any manner likely to cause confusion among consumers or in any manner that disparages or discredits TNL.

 

Equitable Relief

You acknowledge and agree that in the event of certain breaches of the Terms of Use, TNL may suffer irreparable injury, such that no remedy at law will afford it adequate protection against, or appropriate compensation for, such injury. Accordingly, You agree that TNL shall be entitled to any injunctive relief, without having to post a bond, as may be granted by a court of competent jurisdiction.

 

Registration & Restricted Access

Access to the Course is restricted to Course members.  When You or User register, You/User will create a user profile, which may include a username and password. You/ User agree to keep the username and password confidential. If You/User suspect the password has been compromised, You must notify TNL immediately at [email protected]. TNL will not be liable for any loss caused by the unauthorized use of the account; however, You may be liable to TNL or other third parties for any losses incurred due to such unauthorized use.

 

TNL may disable Your/User’s username and password at its sole discretion. 

 

TNL reserves the right to modify methods for registration and access levels of registered users from time to time. 

 

Communication - Electronic Notice

You consent to receive communications from TNL electronically. You agree that all legal notices provided via electronic means from TNL satisfy any requirement for written notice.

 

Third Parties

The Course offers resources that may contain links to third-party websites that are not governed or controlled by TNL. You represent and warrant that You have read and agree to be bound by all applicable Terms of Use and policies for any third-party websites. TNL assumes no control or liability over the content of any third-party sites. You, on behalf of Yourself and User, expressly hold harmless TNL from any and all liability related to Your/User’s use of a third-party website. 

 

Prior to engaging in any commercial transactions with any third parties discovered through or linked on the Course, You must complete any necessary investigation or due diligence. If there is a dispute for any commercial transactions with a third party discovered through or linked in the Course, You, on behalf of Yourself and User, expressly hold TNL harmless from any and all liability in any dispute.

 

No Warranties

The Course is provided on an "as is" and "as available" basis without any representations or warranties, expressed or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose. TNL makes no representations or warranties in relation to the Course or the information and materials provided therein. 

 

TNL makes no warranty the Course will meet Your requirements; will be available uninterrupted; timely and free of viruses or bugs; or represents the full functionality, accuracy, and reliability of the Course. 

 

Limitation of Liability

TO THE MAXIMUM EXTENT ALLOWABLE BY LAW, TNL WILL NOT BE LIABILE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE OR SPECIAL DAMAGES OF ANY KIND, HOWEVER CAUSED, INCLUDING LOSS OF PROFITS, REVENUE, DATA OR USE, INCURRED BY YOU, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY OR OTHERWISE, EVEN IF THE OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  TNL’S SOLE LIABILITY UNDER THESE TERMS OF USE IS THE PURCHASE PRICE PAID FOR THE COURSE.

 

Indemnity

You, on behalf of Yourself and User, agree to defend, indemnify and hold TNL, its members, employees, officers, directors, managers and agents harmless from and against any and all losses, claims, suits, actions, liabilities, obligations, costs and expenses (including reasonable attorneys' fees and expenses) which TNL suffers as a result of third-party claims based on TNL’s affiliation with You or User or the use of the Course or products therein.

 

Miscellaneous

The Terms of Use will be governed and construed in accordance with the laws of the State of Virginia. Any controversy or claim arising out of or relating to the Terms of Use, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of any such arbitration shall be in or near Greene County, Virginia. The parties also agree that the AAA Optional Rules for Emergency Measures of Protection shall apply to the proceedings. If any provision(s) of the Terms of Use is held to be invalid, illegal or unenforceable, the remaining provisions shall be severable and enforceable. If a provision is excessively broad, such a provision shall be limited or reduced in scope so as to be enforceable. The Terms of Use may not be assigned by You or User without TNL’s prior written consent, however, the Terms of Use may be assigned by TNL in its sole discretion. The Terms of Use are the final, complete and exclusive agreement of the parties with respect to the Course offered by TNL. TNL reserves the right to amend, alter, or modify the Terms of Use at any time. All notices with respect to the Terms of Use must be in writing and may be via email to [email protected] for TNL and to Your email address.
